Terms of Service

1. Acceptance of Terms

By accessing or using PetPass ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform. These terms apply to all users, including pet owners, veterinary professionals, organizations, and visitors.

2. Description of Service

PetPass provides a digital pet passport and health management platform that enables users to create, manage, and share pet identification documents, health records, vaccination histories, and travel documentation. The Platform includes features for pet owners, veterinary clinics, shelters, insurers, and transport providers.

3. Account Registration

To use the Platform, you must create an account with accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must immediately notify us of any unauthorized use.

We reserve the right to approve, reject, suspend, or terminate accounts at our discretion, including accounts that violate these terms or are created with false information.

4. Subscriptions and Billing

• Free Plan: Basic features are available at no cost with limited functionality.
• Paid Plans: Premium features require a subscription. Pricing, features, and terms are displayed on the Platform and may change with notice.
• Billing: Subscription fees are billed in advance on a recurring basis (monthly or annually). Payment is processed securely through Stripe.
• Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period. No refunds are issued for partial billing periods.
• Trial Periods: Some plans include a trial period. If you do not cancel before the trial ends, you will be charged automatically.

5. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws
• Upload false, misleading, or fraudulent pet information or documents
• Attempt to gain unauthorized access to other accounts or Platform systems
• Interfere with or disrupt the Platform's infrastructure or security
• Use automated tools, bots, or scrapers to access the Platform without permission
• Impersonate any person or entity, or falsely state your affiliation
• Upload content that infringes intellectual property rights
• Use the Platform to transmit malware, spam, or harmful content

6. Pet Data and Records

You are solely responsible for the accuracy and completeness of pet information, health records, and documents uploaded to the Platform. PetPass does not independently verify the accuracy of user-submitted data unless verified by a registered veterinary provider through the Platform.

Digital passports created through PetPass are supplementary identification tools and may not replace legally required physical documents for international pet travel. Always check destination country requirements before traveling.

7. Organization Accounts

Organizations (veterinary clinics, shelters, insurers, airlines) must provide accurate business information and maintain valid professional credentials where applicable. Organization administrators are responsible for managing team member access and ensuring appropriate use by their staff.

8. Intellectual Property

All content, features, and functionality of the Platform — including design, code, text, graphics, logos, and trademarks — are owned by PetPass and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

You retain ownership of content you upload (photos, documents, records) but grant PetPass a limited license to store, display, and process that content as necessary to provide the service.

9. Limitation of Liability

To the maximum extent permitted by law, PetPass shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Indemnification

You agree to indemnify and hold harmless PetPass, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform, your violation of these terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Ontario, Canada.

13. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email or prominent notice on the Platform. Continued use after changes constitutes acceptance.
